These Terms of Service (“Terms”) govern your use of the maigica wand platform and related services (“Service”), operated by maigica. By accessing or using the Service, you agree to be bound by these Terms.

Key points: The Service provides AI-generated responses that may be inaccurate. It is not a substitute for professional advice. You are responsible for your account and how you use the Service.

1. Acceptance of Terms

By creating an account, accessing the Service, or using any features, you confirm that you are at least 16 years old and agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Service Description

maigica wand is a conversational AI assistant platform. Features may include text and voice chat, web search, email integration, smart notebook, text-to-speech, and third-party tool integrations. The Service is provided “as is” and may change at any time.

3. Account Responsibilities

You must provide accurate information when creating an account.
You are responsible for maintaining the confidentiality of your credentials.
You are responsible for all activity under your account.
Notify us immediately at hello@maigica.ai if you suspect unauthorized use.

4. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or to violate any laws.
Attempt to reverse-engineer, decompile, or extract the source code of the Service.
Use automated tools to scrape, crawl, or extract data from the Service.
Transmit malware, spam, or any harmful content.
Impersonate another person or entity.
Use the Service to generate content that is hateful, violent, or exploitative.
Circumvent usage quotas, billing, or access controls.
Resell or redistribute the Service without written permission.

5. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate responses. AI-generated content:

May be inaccurate, incomplete, or outdated. Always verify important information independently.
Is not professional advice. The Service does not replace medical, legal, financial, or other professional guidance.
May vary between sessions. The same question may produce different answers.

You are solely responsible for how you use AI-generated content and any decisions based on it.

6. Intellectual Property

The Service, including its code, design, and branding, is owned by maigica and protected by applicable intellectual property laws.
Content you create (notebook entries, uploaded data) remains yours.
You grant us a limited license to process your content solely to provide and improve the Service.

7. Billing & Subscriptions

Free tiers are subject to usage quotas. Paid plans provide additional capacity.
Subscriptions are billed monthly. Unused quota does not roll over.
You may cancel at any time. Cancellation takes effect at the end of the current billing period.
Refunds are not provided for partial billing periods.
We reserve the right to change pricing with 30 days’ notice.

8. Data & Privacy

Your data is handled according to our Privacy Policy. By using the Service, you acknowledge and agree to the data practices described therein.

9. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime.
The Service may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control.
We may modify, suspend, or discontinue features with reasonable notice when possible.

10. Termination

You may delete your account at any time by contacting hello@maigica.ai.
We may suspend or terminate your account if you violate these Terms.
Upon termination, you may request export of your data within 30 days.
Provisions that by nature should survive termination (liability, IP, disputes) will survive.

11. Limitation of Liability

To the maximum extent permitted by law:

The Service is provided “as is” without warranties of any kind, express or implied.
maigica is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law & Disputes

These Terms are governed by the laws of Poland. Any disputes shall be resolved by the competent courts in Poland. Before initiating formal proceedings, both parties agree to attempt resolution through good-faith negotiation.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or an in-app notice. Continued use of the Service after changes constitutes acceptance of the updated Terms.

Niniejszy Regulamin („Regulamin”) reguluje korzystanie z platformy maigica wand i powiązanych usług („Usługa”), prowadzonych przez maigica. Korzystając z Usługi lub uzyskując do niej dostęp, zgadzasz się na warunki niniejszego Regulaminu.

Najważniejsze: Usługa generuje odpowiedzi za pomocą AI, które mogą być niedokładne. Nie zastępuje profesjonalnej porady. Jesteś odpowiedzialny za swoje konto i sposób korzystania z Usługi.

1. Akceptacja Regulaminu

Tworząc konto, uzyskując dostęp do Usługi lub korzystając z jakichkolwiek funkcji, potwierdzasz, że masz co najmniej 16 lat i zgadzasz się na niniejszy Regulamin oraz naszą Politykę Prywatności. Jeśli się nie zgadzasz, nie korzystaj z Usługi.

2. Opis Usługi

maigica wand to platforma konwersacyjnych asystentów AI. Funkcje mogą obejmować czat tekstowy i głosowy, wyszukiwanie w internecie, integrację z e-mailem, inteligentny notatnik, syntezę mowy i integracje z narzędziami zewnętrznymi. Usługa jest świadczona w stanie „takim, jaki jest” i może ulec zmianom w dowolnym momencie.

3. Obowiązki związane z kontem

Podczas tworzenia konta musisz podać prawdziwe informacje.
Jesteś odpowiedzialny za zachowanie poufności swoich danych logowania.
Ponosisz odpowiedzialność za wszelkie działania wykonywane na Twoim koncie.
Niezwłocznie powiadom nas pod adresem hello@maigica.ai, jeśli podejrzewasz nieautoryzowane użycie.

4. Dozwolone użytkowanie

Zgadzasz się nie:

Używać Usługi w celach niezgodnych z prawem.
Podejmować prób inżynierii wstecznej, dekompilacji lub wyodrębnienia kodu źródłowego Usługi.
Używać zautomatyzowanych narzędzi do scraping, crawling lub wyodrębniania danych z Usługi.
Przesyłać złośliwego oprogramowania, spamu ani żadnych szkodliwych treści.
Podszywać się pod inną osobę lub podmiot.
Używać Usługi do generowania treści nienawistnych, przemocowych lub eksploatacyjnych.
Obchodzić limitów użycia, rozliczeń lub kontroli dostępu.
Odsprzedawać lub redystrybuować Usługę bez pisemnej zgody.

5. Zastrzeżenie dotyczące treści generowanych przez AI

Usługa wykorzystuje sztuczną inteligencję do generowania odpowiedzi. Treści generowane przez AI:

Mogą być niedokładne, niekompletne lub nieaktualne. Zawsze weryfikuj ważne informacje niezależnie.
Nie stanowią profesjonalnej porady. Usługa nie zastępuje porad medycznych, prawnych, finansowych ani innych profesjonalnych wskazówek.
Mogą się różnić między sesjami. To samo pytanie może generować różne odpowiedzi.

Ponosisz wyłączną odpowiedzialność za sposób wykorzystania treści generowanych przez AI i wszelkie decyzje podjęte na ich podstawie.

6. Własność intelektualna

Usługa, w tym jej kod, projekt i marka, jest własnością maigica i jest chroniona obowiązującymi prawami własności intelektualnej.
Treści, które tworzysz (wpisy w notatniku, przesłane dane), pozostają Twoje.
Udzielasz nam ograniczonej licencji na przetwarzanie Twoich treści wyłącznie w celu świadczenia i ulepszania Usługi.

7. Rozliczenia i subskrypcje

Darmowe plany podlegają limitom użycia. Płatne plany zapewniają dodatkową pojemność.
Subskrypcje są rozliczane miesięcznie. Niewykorzystany limit nie przechodzi na kolejny miesiąc.
Możesz anulować w dowolnym momencie. Anulowanie wchodzi w życie z końcem bieżącego okresu rozliczeniowego.
Nie przewidujemy zwrotów za niepełne okresy rozliczeniowe.
Zastrzegamy sobie prawo do zmiany cen z 30-dniowym wyprzedzeniem.

8. Dane i prywatność

Twoje dane są obsługiwane zgodnie z naszą Polityką Prywatności. Korzystając z Usługi, przyjmujesz do wiadomości i zgadzasz się na opisane w niej praktyki dotyczące danych.

9. Dostępność Usługi

Dążymy do zapewnienia niezawodnej usługi, ale nie gwarantujemy 100% dostępności.
Usługa może być tymczasowo niedostępna z powodu konserwacji, aktualizacji lub okoliczności od nas niezależnych.
Możemy modyfikować, zawieszać lub wycofywać funkcje z rozsądnym wyprzedzeniem, gdy to możliwe.

10. Rozwiązanie umowy

Możemy zawiesić lub usunąć Twoje konto, jeśli naruszasz niniejszy Regulamin.
Po rozwiązaniu możesz żądać eksportu swoich danych w ciągu 30 dni.

11. Ograniczenie odpowiedzialności

W maksymalnym zakresie dozwolonym przez prawo:

Usługa jest świadczona w stanie „takim, jaki jest”, bez jakichkolwiek gwarancji, wyraźnych lub dorozumianych.
maigica nie ponosi odpowiedzialności za żadne pośrednie, uboczne, wynikowe lub karne szkody wynikające z korzystania z Usługi.
Nasza łączna odpowiedzialność za roszczenia związane z Usługą nie przekroczy kwoty, którą zapłaciłeś nam w ciągu 12 miesięcy poprzedzających roszczenie.

12. Prawo właściwe i spory

Niniejszy Regulamin podlega prawu polskiemu. Wszelkie spory będą rozstrzygane przez właściwe sądy w Polsce. Przed wszczęciem formalnego postępowania obie strony zobowiązują się do podjęcia próby rozwiązania sporu w drodze negocjacji w dobrej wierze.

13. Zmiany Regulaminu

Możemy od czasu do czasu aktualizować niniejszy Regulamin. Istotne zmiany będą komunikowane za pośrednictwem e-maila lub powiadomienia w aplikacji. Dalsze korzystanie z Usługi po zmianach oznacza akceptację zaktualizowanego Regulaminu.

Wichtigste Punkte: Der Dienst liefert KI-generierte Antworten, die ungenau sein können. Er ersetzt keine professionelle Beratung. Sie sind für Ihr Konto und die Nutzung des Dienstes verantwortlich.

1. Annahme der AGB

Durch die Erstellung eines Kontos, den Zugriff auf den Dienst oder die Nutzung von Funktionen bestätigen Sie, dass Sie mindestens 16 Jahre alt sind und diesen AGB sowie unserer Datenschutzerklärung zustimmen. Wenn Sie nicht einverstanden sind, nutzen Sie den Dienst nicht.

2. Beschreibung des Dienstes

maigica wand ist eine Plattform für konversationelle KI-Assistenten. Funktionen können Text- und Sprachchat, Websuche, E-Mail-Integration, intelligentes Notizbuch, Text-to-Speech und Drittanbieter-Integrationen umfassen. Der Dienst wird „wie besehen“ bereitgestellt und kann jederzeit geändert werden.

3. Kontoverantwortung

Sie müssen bei der Kontoerstellung wahrheitsgemäße Angaben machen.
Sie sind für die Geheimhaltung Ihrer Zugangsdaten verantwortlich.
Sie sind für alle Aktivitäten unter Ihrem Konto verantwortlich.
Benachrichtigen Sie uns sofort unter hello@maigica.ai bei Verdacht auf unbefugte Nutzung.

4. Zulässige Nutzung

Sie verpflichten sich, Folgendes zu unterlassen:

Nutzung des Dienstes für illegale Zwecke oder Gesetzesverstoße.
Versuche der Rückentwicklung, Dekompilierung oder Extraktion des Quellcodes.
Verwendung automatisierter Tools zum Scraping, Crawling oder zur Datenextraktion.
Übermittlung von Malware, Spam oder schädlichen Inhalten.
Identitätsdiebstahl oder Vortäuschung einer anderen Person.
Nutzung des Dienstes zur Erstellung hasserfüllter, gewalttätiger oder ausbeuterischer Inhalte.
Umgehung von Nutzungskontingenten, Abrechnung oder Zugriffskontrollen.
Weiterverkauf oder Weiterverbreitung des Dienstes ohne schriftliche Genehmigung.

5. Haftungsausschluss für KI-generierte Inhalte

Der Dienst nutzt künstliche Intelligenz zur Generierung von Antworten. KI-generierte Inhalte:

Können ungenau, unvollständig oder veraltet sein. Überprüfen Sie wichtige Informationen stets unabhängig.
Stellen keine professionelle Beratung dar. Der Dienst ersetzt keine medizinische, rechtliche, finanzielle oder sonstige Fachberatung.
Können zwischen Sitzungen variieren. Dieselbe Frage kann unterschiedliche Antworten liefern.

Sie sind allein verantwortlich für die Verwendung KI-generierter Inhalte und darauf basierende Entscheidungen.

6. Geistiges Eigentum

Der Dienst einschließlich Code, Design und Marke ist Eigentum von maigica und durch geltendes Recht geschützt.
Von Ihnen erstellte Inhalte (Notizbuch-Einträge, hochgeladene Daten) gehören Ihnen.
Sie gewähren uns eine beschränkte Lizenz zur Verarbeitung Ihrer Inhalte ausschließlich zur Bereitstellung und Verbesserung des Dienstes.

7. Abrechnung & Abonnements

Kostenlose Tarife unterliegen Nutzungskontingenten. Bezahltarife bieten zusätzliche Kapazität.
Abonnements werden monatlich abgerechnet. Ungenutztes Kontingent verfällt.
Sie können jederzeit kündigen. Die Kündigung wird zum Ende des laufenden Abrechnungszeitraums wirksam.
Erstattungen für angebrochene Abrechnungszeiträume werden nicht gewährt.
Wir behalten uns das Recht vor, Preise mit 30 Tagen Vorlauf zu ändern.

8. Daten & Datenschutz

Ihre Daten werden gemäß unserer Datenschutzerklärung behandelt. Mit der Nutzung des Dienstes erkennen Sie die darin beschriebenen Datenpraktiken an.

9. Verfügbarkeit des Dienstes

Wir streben einen zuverlässigen Dienst an, garantieren jedoch keine 100%ige Verfügbarkeit.
Der Dienst kann vorübergehend wegen Wartung, Updates oder höherer Gewalt nicht verfügbar sein.
Wir können Funktionen nach Möglichkeit mit angemessener Vorankündigung ändern, aussetzen oder einstellen.

10. Kündigung

Sie können Ihr Konto jederzeit löschen, indem Sie sich an hello@maigica.ai wenden.
Wir können Ihr Konto sperren oder kündigen, wenn Sie gegen diese AGB verstoßen.
Nach Kündigung können Sie innerhalb von 30 Tagen den Export Ihrer Daten anfordern.
Bestimmungen, die ihrer Natur nach die Kündigung überdauern sollen (Haftung, geistiges Eigentum, Streitigkeiten), bleiben in Kraft.

11. Haftungsbeschränkung

Im maximal gesetzlich zulässigen Umfang:

Der Dienst wird „wie besehen“ ohne jegliche ausdrückliche oder stillschweigende Gewährleistung bereitgestellt.
maigica haftet nicht für indirekte, beiläufige, Folge- oder Strafschäden aus der Nutzung des Dienstes.
Unsere Gesamthaftung für Ansprüche im Zusammenhang mit dem Dienst ist auf den Betrag beschränkt, den Sie uns in den 12 Monaten vor dem Anspruch gezahlt haben.

12. Anwendbares Recht & Streitigkeiten

Diese AGB unterliegen dem Recht der Republik Polen. Streitigkeiten werden von den zuständigen Gerichten in Polen entschieden. Vor Einleitung formeller Verfahren verpflichten sich beide Parteien zu einem Lösungsversuch durch Verhandlungen in gutem Glauben.

13. Änderungen dieser AGB

Wir können diese AGB von Zeit zu Zeit aktualisieren. Wesentliche Änderungen werden per E-Mail oder In-App-Benachrichtigung mitgeteilt. Die fortgesetzte Nutzung des Dienstes nach Änderungen gilt als Zustimmung zu den aktualisierten AGB.

4. Utilisation acceptable

Vous vous engagez à ne pas :

Utiliser le Service à des fins illégales ou en violation de la loi.
Tenter la rétro-ingénierie, la décompilation ou l’extraction du code source.
Utiliser des outils automatisés pour le scraping, le crawling ou l’extraction de données.
Transmettre des logiciels malveillants, du spam ou du contenu nuisible.
Usurper l’identité d’une autre personne ou entité.
Utiliser le Service pour générer du contenu haineux, violent ou exploitant autrui.
Contourner les quotas d’utilisation, la facturation ou les contrôles d’accès.
Revendre ou redistribuer le Service sans autorisation écrite.

5. Avertissement sur le contenu généré par IA

Le Service utilise l’intelligence artificielle pour générer des réponses. Le contenu généré par IA :

Peut être inexact, incomplet ou obsolète. Vérifiez toujours les informations importantes de manière indépendante.
Ne constitue pas un conseil professionnel. Le Service ne remplace pas les conseils médicaux, juridiques, financiers ou autres.
Peut varier entre les sessions. La même question peut produire des réponses différentes.

Vous êtes seul responsable de l’utilisation du contenu généré par IA et des décisions prises sur cette base.

6. Propriété intellectuelle

Le Service, y compris son code, son design et sa marque, appartient à maigica et est protégé par les lois applicables.
Le contenu que vous créez (entrées du carnet, données téléchargées) vous appartient.
Vous nous accordez une licence limitée pour traiter votre contenu uniquement afin de fournir et améliorer le Service.

7. Facturation & abonnements

Les formules gratuites sont soumises à des quotas d’utilisation. Les formules payantes offrent une capacité supplémentaire.
Les abonnements sont facturés mensuellement. Le quota non utilisé n’est pas reporté.
Vous pouvez annuler à tout moment. L’annulation prend effet à la fin de la période de facturation en cours.
Les remboursements ne sont pas accordés pour les périodes de facturation partielles.
Nous nous réservons le droit de modifier les tarifs avec un préavis de 30 jours.

8. Données & confidentialité

Vos données sont traitées conformément à notre Politique de Confidentialité. En utilisant le Service, vous reconnaissez et acceptez les pratiques décrites dans cette politique.

9. Disponibilité du Service

Nous visons un service fiable mais ne garantissons pas une disponibilité de 100%.
Le Service peut être temporairement indisponible pour maintenance, mises à jour ou circonstances indépendantes de notre volonté.
Nous pouvons modifier, suspendre ou abandonner des fonctionnalités avec un préavis raisonnable si possible.

10. Résiliation

Vous pouvez supprimer votre compte à tout moment en contactant hello@maigica.ai.
Nous pouvons suspendre ou résilier votre compte en cas de violation de ces Conditions.
Après résiliation, vous pouvez demander l’export de vos données dans un délai de 30 jours.
Les dispositions qui, par nature, doivent survivre à la résiliation (responsabilité, propriété intellectuelle, litiges) restent en vigueur.

11. Limitation de responsabilité

Dans la mesure maximale permise par la loi :

Le Service est fourni « en l’état » sans aucune garantie, expresse ou implicite.
maigica ne saurait être tenu responsable de dommages indirects, accessoires, consécutifs ou punitifs résultant de l’utilisation du Service.
Notre responsabilité totale pour toute réclamation liée au Service ne dépassera pas le montant que vous nous avez versé au cours des 12 mois précédant la réclamation.

12. Droit applicable & litiges

Ces Conditions sont régies par le droit polonais. Tout litige sera tranché par les tribunaux compétents en Pologne. Avant d’engager une procédure formelle, les deux parties s’engagent à tenter une résolution par négociation de bonne foi.

13. Modifications de ces Conditions

Nous pouvons mettre à jour ces Conditions de temps en temps. Les modifications substantielles seront communiquées par e-mail ou notification dans l’application. L’utilisation continue du Service après les modifications vaut acceptation des Conditions mises à jour.

El Servicio utiliza inteligencia artificial para generar respuestas. El contenido generado por IA:

Puede ser inexacto, incompleto o desactualizado. Siempre verifique la información importante de forma independiente.
No constituye asesoramiento profesional. El Servicio no reemplaza el asesoramiento médico, legal, financiero u otro profesional.
Puede variar entre sesiones. La misma pregunta puede producir respuestas diferentes.

Usted es el único responsable del uso del contenido generado por IA y de las decisiones basadas en él.

6. Propiedad intelectual

El Servicio, incluido su código, diseño y marca, es propiedad de maigica y está protegido por las leyes aplicables.
El contenido que crea (entradas del cuaderno, datos cargados) sigue siendo suyo.
Nos otorga una licencia limitada para procesar su contenido exclusivamente para proporcionar y mejorar el Servicio.

7. Facturación y suscripciones

Los planes gratuitos están sujetos a cuotas de uso. Los planes de pago proporcionan capacidad adicional.
Las suscripciones se facturan mensualmente. La cuota no utilizada no se acumula.
Puede cancelar en cualquier momento. La cancelación se hace efectiva al final del período de facturación actual.
No se proporcionan reembolsos por períodos de facturación parciales.
Nos reservamos el derecho de cambiar los precios con 30 días de preaviso.

8. Datos y privacidad

Sus datos se manejan de acuerdo con nuestra Política de Privacidad. Al utilizar el Servicio, reconoce y acepta las prácticas de datos descritas en ella.

9. Disponibilidad del Servicio

Nos esforzamos por ofrecer un servicio fiable, pero no garantizamos una disponibilidad del 100%.
El Servicio puede no estar disponible temporalmente por mantenimiento, actualizaciones o circunstancias fuera de nuestro control.
Podemos modificar, suspender o descontinuar funciones con un aviso razonable cuando sea posible.

10. Terminación

Puede eliminar su cuenta en cualquier momento contactando a hello@maigica.ai.
Podemos suspender o cancelar su cuenta si viola estos Términos.
Tras la terminación, puede solicitar la exportación de sus datos dentro de los 30 días.
Las disposiciones que por su naturaleza deben sobrevivir a la terminación (responsabilidad, propiedad intelectual, disputas) permanecerán vigentes.

11. Limitación de responsabilidad

En la medida máxima permitida por la ley:

El Servicio se proporciona «tal cual» sin garantías de ningún tipo, expresas o implícitas.
maigica no será responsable de daños indirectos, incidentales, consecuentes o punitivos derivados del uso del Servicio.
Nuestra responsabilidad total por cualquier reclamación relacionada con el Servicio no excederá el importe que nos haya pagado en los 12 meses anteriores a la reclamación.

12. Legislación aplicable y disputas

Estos Términos se rigen por las leyes de Polonia. Cualquier disputa será resuelta por los tribunales competentes en Polonia. Antes de iniciar procedimientos formales, ambas partes acuerdan intentar la resolución mediante negociación de buena fe.

13. Cambios en estos Términos

Podemos actualizar estos Términos de vez en cuando. Los cambios materiales se comunicarán por correo electrónico o notificación en la aplicación. El uso continuado del Servicio después de los cambios constituye la aceptación de los Términos actualizados.
